1. Agreement to these terms
These Terms of Use (“Terms”) govern your access to and use of the DiveHub website, applications, and related services (the “Services”) operated by DiveHub (“we”, “us”, “our”). By creating an account, accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
2. The Services
DiveHub provides tools to log, manage and (where offered) share scuba diving activity information. We may add, change, or remove features, subject to applicable law and any commitments we have made to you. We aim for reliable operation but do not guarantee the Services will be error-free, uninterrupted, or meet your specific needs.
3. Your account
You are responsible for safeguarding your login credentials and for all activity on your account. You must provide accurate information and keep it up to date. You may not use another person’s account without permission. Notify us at hello@dive-hub.net if you suspect unauthorized access.
4. Acceptable use
You may not: misuse, disrupt, or attempt to gain unauthorized access to the Services or our systems; use the Services in violation of law or to harm others; upload malware or harmful content; scrape or automate access in a way that unreasonably burdens the Services; impersonate any person or entity; or use the Services for any high-risk or illegal activity, including in connection with diving in violation of your training, local law, or good safety practice.
5. Your content and licence to us
You retain rights to the content you submit, such as dive logs, text, and photos (“Your Content”). To run the Services, you grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, process, display, and create backup copies of Your Content solely to provide, secure, and improve the Services, and to share it only as you direct through product features and as described in our Privacy Policy.
You grant the right for your dive data to be used anonymously for the purpose of statistics, scientific research and product improvements.
6. Third parties
The Services may link to or integrate with third parties (e.g. app stores, sign-in, maps). We are not responsible for third-party content, services, or policies. Your use of them is at your own risk and subject to their terms.
7. Diving and safety
DiveHub is a digital logbook and planning tool only. Diving is inherently hazardous. We do not provide medical, safety, or training advice, and the Services are not a substitute for proper training, professional judgment, local regulations, and safe diving practice. You are solely responsible for the decisions you make in connection with your diving activities.
8. Disclaimers
The Services are provided on an “as is” and “as available” basis, to the fullest extent permitted by law. We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
9. Limitation of liability
To the fullest extent permitted by law, DiveHub and our affiliates, directors, and employees are not liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from your use of the Services. Our total liability for all claims related to the Services in any twelve-month period is limited to the amount you paid us (if any) in that period for the Services, or fifty pounds sterling (£50), whichever is greater, or the minimum amount permitted if your jurisdiction does not allow the foregoing. Some jurisdictions do not allow certain limitations; in those cases our liability is limited to the maximum allowed by law.
10. Indemnity
You will defend and indemnify DiveHub and its officers and employees from claims, damages, and expenses (including reasonable legal fees) arising from your use of the Services, Your Content, or your breach of these Terms, except to the extent caused by our willful misconduct.
11. Termination and suspension
We may suspend or terminate your access if you breach these Terms or if we are required to do so for legal, security, or operational reasons, with or without prior notice as permitted by law. You may stop using the Services and request account deletion in line with our Privacy Policy. Provisions that by their nature should survive (including Disclaimers, Limitation of Liability, and Governing law) will survive.
12. Changes
We may update these Terms. We will post the updated Terms on this page and update the “Last updated” date. Where required by law, we will provide additional notice. Your continued use after the effective date constitutes acceptance of the revised Terms.
13. Governing law and disputes
These Terms are governed by the laws of England and Wales, without regard to conflict of law rules, and the courts of England and Wales have exclusive jurisdiction, subject to any mandatory rights you may have in your home jurisdiction as a consumer. Before bringing formal legal proceedings, you agree to contact us at hello@dive-hub.net to try to resolve the issue informally.
